Types of Duties Owed. In Pennsylvania, the owner of real property can be liable for injuries and accidents that happen on the property, depending on a few factors. Typically, the property owner's knowledge of a dangerous condition is important. A business owner, for example, owes a duty to inspect the property for any dangerous condition that might cause injury to a customer. A licensee, on the other hand, is merely a guest on the property for a limited purpose (not business related) and a more relaxed duty is therefore owed to the licensee. A trespasser is owed the least amount of care, although, liabilitly can still exist for harm to trespassers under certain circumstances. Know Your Rights. Your rights to sue will depend on (1) whether you were an invitee, licensee, or trespasser, and (2) whether the owner of the property violated a duty to you. Unfortunately, there is no bright line rule for when an property owner will always be liable for injuries and accidents that happen on the property.
